The Brussels reference rent grid was created to bring transparency to the rental market. Under amended provisions of the Brussels Housing Code effective since May 1, 2025, landlords are legally prohibited from charging excessive rents.
In practice, a rent is legally presumed excessive if it exceeds the regional reference rent by more than 20%. Furthermore, a rent may also be declared abusive even below the 20% threshold if the dwelling exhibits substantial quality defects or severe local environmental nuisances.
The regional calculation relies on an extensive database of surveyed tenancies, indexed annually. Baseline values factor in key structural criteria: habitable surface area, year of construction, double glazing, and neighborhood location indices.
Property amenities further calibrate the range: central heating, a second bathroom, private outdoor space, parking, and the official PEB energy performance rating. Landlords are legally required to explicitly state the reference rent and corresponding range in all new primary residence lease agreements.
Tenants who believe they are subject to excessive rent can initiate a formal review procedure starting in the 3rd month of occupancy (for short-term leases) or the 4th month (for standard 9-year leases).
In case of disagreement, either party may refer the matter to the Joint Tenancy Commission (CPL / PHC) for neutral conciliation. If no agreement is reached, the case proceeds before the Justice of the Peace (Juge de Paix), who holds statutory authority to mandate rent reductions with retroactive reimbursement.
