
Rental property management in Brussels has reached a new digital milestone. Since November 1, 2024, residential landlords must comply with a major regulatory shift: the obligation to register primary residence leases not only with the federal tax authority via MyRent, but also on the regional platform Irisrent. Here is a clear guide to this dual procedure and the legal consequences of non-compliance.
Registering a residential tenancy agreement has always been a statutory obligation in Belgium, granting the lease a "certain date" (date certaine) and protecting both parties. Historically, this was processed exclusively through the Federal Public Service (FPS) Finance via the MyRent application.
Effective November 1, 2024, the Brussels-Capital Region instituted its own mandatory platform: Irisrent. Landlords are now legally required to submit lease agreements (and entry condition reports) across both platforms. This dual procedure serves two distinct purposes: MyRent ensures federal tax compliance, while Irisrent populates the Brussels regional registry to monitor rental market trends, indexation limits, and housing health standards.
The legal timeframe remains unchanged: the lessor has a strict 2-month window from the date of lease signing to complete registration.
For leases dedicated exclusively to residential accommodation (primary residence, shared housing, student rentals), registration is completely free of charge on both MyRent and Irisrent. Both filings are completed online using electronic ID (eID or itsme authentication).
Failing to register a residential lease carries severe legal and financial repercussions for property owners:
Tenant Termination Without Notice or Penalty: This is the most severe statutory sanction. Once the 2-month deadline expires, as long as the lease remains unregistered, the tenant may terminate the agreement immediately without serving the standard 3-month notice period and without paying any lease-break compensation.
Prohibition of Rent Indexation: The landlord is legally barred from applying annual rent indexation until the lease is formally registered.
Tax Administration Fines: The federal tax authority can impose administrative penalties of €25 per unregistered contract.
